Choosing an Attorney
When filing for bankruptcy under Chapter 7 or Chapter
13, you will need to hire an attorney. Depending on
which chapter under which you choose to file, you will
want an attorney experienced in filing petitions for
that specific chapter of the bankruptcy code. While
an attorney may be very experienced in petitioning under
Chapter 7, he or she may know little about Chapter 13
and vice versa, so you must select your attorney carefully.
Some of the resources you can use for finding a qualified
attorney are:
- Friends or relatives – they may know of an attorney
who has handled Chapter 7 or Chapter 13 bankruptcy
petitions.
- The bankruptcy judge's office in your area – ask
for the names of several attorneys in your area who
file Chapter 7 and Chapter 13 cases.
- Lawyer Referral Service – call the chapter sponsored
by your State Bar. Ask for the names of attorneys
in your area who handle Chapter 7 and Chapter 13 cases

- The Yellow Pages – check your telephone book. After
individual listings, attorneys are listed by specialty.
Some attorneys designate family law, debtor law, taxation,
or other specialties. Look for attorneys designated
under bankruptcy, consumer or debtor law.
